The Master in Equity is part of the South Carolina Unified
Court System and serves as judge for civil lawsuits filed in Circuit Court for Dorchester
County. The Master in Equity also serves as Special Circuit Judge.
The Master hears Circuit Court Common Pleas cases referred
to him for decision such as real property and business cases, injunctions, default cases with
unliquidated damages, supplementary proceedings, and cases referred by consent of all parties.
Real property cases include mortgage foreclosures, quieting title, partitions, boundary
disputes and mechanic's liens.
As Special Circuit Judge, the Master hears motions pending
in jury and non-jury cases and conducts trials on the merits of non-jury cases. He reviews and
signs assorted administrative orders requiring no hearing. These include orders such as
judgments by default for liquidated damages, orders to change venue, orders to dismiss, and
entries of default.
The Master conducts public judicial auctions of real
property pursuant to mortgage foreclosure actions. For foreclosures seeking a deficiency
judgment, he holds a second public auction of the subject property 30 days after the first.
The Master executes and delivers Master's Deeds conveying
title to real property to successful bidders at the public auctions. If appropriate under the
circumstances, he executes and delivers Master's Deeds to parties to suits that establish their
legal interests in real property.
